There are some areas on our Site in which we may request information from you, so that we can best meet your needs. When you access our Site, we may ask you to voluntarily provide us certain information that personally identifies you or could be used to personally identify you (“Personal Information”). Personal Information includes (but is not limited to) the following categories of information: (1) contact data (such as your e-mail address and phone number); (2) demographic data (such as your gender, your date of birth and your zip code); (3) insurance data (such as your insurance carrier, insurance plan, member ID, group ID and payer ID); (4) medical data (such as the doctors, dentists or other healthcare specialists, professionals, providers, or organizations (collectively, “Healthcare Providers”) you have visited, your reasons for visit, your dates of visit, your medical history, and other medical and health information you choose to share with us); and (5) other identifying information that you voluntarily choose to provide to us, including without limitation unique identifiers such as passwords, and Personal Information in emails or letters that you send to us. We may also collect additional information, which may be Personal Information, as otherwise described to you at the point of collection or pursuant to your consent. You may still access and use some of the Services if you choose not to provide us with any Personal Information, but features of the Services that require your Personal Information will not be accessible to you.
We also may automatically collect certain data when you use the Services, such as (1) IP address; (2) domain server; (3) type of device(s) used to access the Services; (4) web browser(s) used to access the Services; (5) referring webpage or other source through which you accessed the Services; (6) geolocation information; and (7) other statistics and information associated with the interaction between your browser or device and the Services (collectively “Traffic Data”). Depending on applicable law, some Traffic Data may be Personal Information.
Under a federal law called the Health Insurance Portability and Accountability Act (“HIPAA”), some demographic, health and/or health-related information that Sway Health collects as part of providing the Services may be considered “protected health information” or “PHI.” Specifically, when Sway Health receives identifiable information about you from or on behalf of your Healthcare Providers, this information is considered PHI.
Information from your doctor:
If you request that a Sway Health Client ("Client") contact you regarding certain services ("Services") contained on one of our Sites, Clients may collect additional personal and health information from you ("Clinician Information"). Sway Health is not responsible for the security, integrity or maintenance of Clinician Information stored on a Client’s servers, Electronic Health Records, or physically on-premise at a Client’s location.
Furthermore, by submitting your personal information and information about previous doctors regarding our “Referral Request” service, you acknowledge and agree to our Terms and Conditions and authorize a formal Medical Records Release. This Release allows Sway Health, Inc. personnel to contact the specified healthcare provider and request clinic notes and referrals relating to your pain conditions. Any clinical notes or patient information collected from previous healthcare providers as a part of your Medical Records Release authorization will be passed directly to the provider you are inquiring about on the Sway site and will not be stored by Sway.
The User Information you provide to us will be kept confidential and used only by us and any Client to which you request we provide your information. We require that all Clients agree to use User Information based on our instructions and in compliance with all relevant laws regarding protection and use of your personal information and any other appropriate confidentiality and security measures. It will not be passed to any other party for marketing purposes. We may also share aggregated customer information such as statistics about our customers, sales, traffic patterns and related site information, with our business partners and other reputable vendors, but such aggregated information will not contain any personally identifying information of any users of the Site. We may disclose or access User Information when we believe in good faith that the law requires it.
Any information that Sway Health collects from you on the Site is information that you specifically and voluntarily provide. You may choose not to provide any or all of the information that is requested on the Site. In the event that you no longer want us to process or utilize your User Information, please contact us.
We take appropriate measures to keep the personal information you disclose to us secure and to only release this information to third parties that share our commitment to privacy. However, we cannot guarantee there will not be a breach and we are not responsible for any breach of security or for the actions of any third parties.
When you use the Site, our servers automatically record information that your browser sends. This may include information such as your web request, Internet Protocol address, browser type, the date and time of your request and one or more cookies that may uniquely identify your browser.
As part of our business strategy, Sway Health or substantially all of its assets may be acquired. In such case, User Information will be part of the transferred assets.
